3. Intellectual Property

The Site, its structure, its visual identity and all elements composing it — including without limitation texts, images, photographs, videos, illustrations, sounds, graphics, logos, trademarks, domain names, databases and software — are protected by the French Intellectual Property Code (in particular Articles L. 111-1, L. 112-1, L. 122-4, L. 335-2 et seq., and Articles L. 341-1 et seq. on database rights) and by applicable international treaties and European Union law.

Unless otherwise stated, these elements are the exclusive property of ELEGELLI or are used with the authorisation of their rights holders.

3.1 Trademarks and distinctive signs

ELEGELLI is a registered trademark owned by ELEGELLI.

The domain name elegelli.com is likewise held by ELEGELLI. Any use of these distinctive signs without prior written authorisation may constitute infringement within the meaning of Articles L. 713-2 and L. 716-4 of the French Intellectual Property Code.

3.2 Permitted and prohibited uses

Any reproduction, representation, modification, adaptation, translation, extraction, re-utilisation, distribution or exploitation, in whole or in part, by any means and on any medium, without ELEGELLI's prior written authorisation, is prohibited and may engage the civil and criminal liability of its author (up to €300,000 in fines and three years' imprisonment, Article L. 335-2 of the French Intellectual Property Code).

This prohibition covers in particular the extraction or re-utilisation of a qualitatively or quantitatively substantial part of the Site's databases, as well as any automated collection process (scraping, harvesting, crawling for reuse) that has not been expressly authorised.

Short quotations for information, criticism, polemic, educational, scientific or analytical purposes are permitted within the limits of Article L. 122-5 of the French Intellectual Property Code, provided the source and the author's name are clearly indicated.

4. Cosmetic Products — Regulatory Information

ELEGELLI manufactures and markets perfumes and toilet preparations, an activity governed by Regulation (EC) No 1223/2009 of the European Parliament and of the Council of 30 November 2009 on cosmetic products, and by Articles L. 5131-1 et seq. of the French Public Health Code.

  • Notification: products placed on the market are notified through the Cosmetic Products Notification Portal (CPNP), in accordance with Article 13 of the Regulation.
  • Product Information File (PIF): kept available to the competent authorities at the address of the Responsible Person, in accordance with Article 11 of the Regulation.
  • Animal testing: in accordance with Article 18 of the Regulation, neither the products nor their ingredients are tested on animals.
  • Supervisory authorities: French National Agency for Medicines and Health Products Safety (ANSM), 143-147 boulevard Anatole France, 93285 Saint-Denis Cedex — ansm.sante.fr; Directorate-General for Competition, Consumer Affairs and Fraud Control (DGCCRF) — economie.gouv.fr/dgccrf.
  • Cosmetovigilance: any undesirable effect may be reported to contact@elegelli.com and declared to the ANSM via signalement.social-sante.gouv.fr.

In accordance with Article 19 of Regulation (EC) No 1223/2009 and Article L. 111-1 of the French Consumer Code, the list of ingredients (INCI nomenclature), the function of the product, any particular precautions for use and the nominal quantity are made available on each product page of the Site before the order is placed.

5. Personal Data

ELEGELLI processes personal data in accordance with Regulation (EU) 2016/679 of 27 April 2016 ("GDPR") and French Data Protection Act No. 78-17 of 6 January 1978, as amended.

5.1 Data controller

The data controller is ELEGELLI, whose details appear in Section 1. Any request relating to personal data may be sent to contact@elegelli.com or by post to the registered office.

5.2 Data protection officer

ELEGELLI has not appointed a data protection officer, the criteria of Article 37 GDPR not being met. The contact point for all data protection matters is the one set out in 5.1.

5.3 Categories of data processed

Depending on your interactions with the Site, the following may be processed: identification data (title, first name, surname); contact details (billing and delivery postal address, email address, telephone number); order and transaction data (products, amounts, history, complaints, returns); payment data (processed exclusively by our payment service provider, ELEGELLI having no access to full card numbers); connection and browsing data (IP address, session identifiers, pages viewed, device, trackers); and any data you voluntarily provide through our forms or customer service.

5.4 Purposes, legal bases and retention periods

Data is processed for the following purposes, on the legal bases set out in Article 6 GDPR:

  • Order management, delivery, invoicing and after-sales serviceperformance of a contract (Art. 6(1)(b)) — retained in the active database for the duration of the commercial relationship, then in intermediate archiving until the applicable limitation periods expire (5 years, Article 2224 of the French Civil Code);
  • Compliance with legal, accounting and tax obligationslegal obligation (Art. 6(1)(c)) — 10 years from the close of the financial year for accounting records (Article L. 123-22 of the French Commercial Code);
  • Customer relationship management and responses to requestslegitimate interest (Art. 6(1)(f)) in providing a quality service — 3 years from the last contact;
  • Sending commercial communications and the newsletterconsent (Art. 6(1)(a)), withdrawable at any time, or legitimate interest for marketing to existing customers regarding similar products (Article L. 34-5 of the French Postal and Electronic Communications Code) — 3 years from the prospect's last contact;
  • Audience measurement, personalisation and advertisingconsent (Art. 6(1)(a)), or legitimate interest for strictly necessary audience measurement exempted from consent under CNIL guidelines — maximum 25 months for audience data;
  • Fraud prevention and Site securitylegitimate interest (Art. 6(1)(f)) — a period proportionate to the purpose, in principle 12 months;
  • Handling of data subject requestslegal obligation (Art. 6(1)(c)) — 1 year from the request, or 3 years where proof of identity is provided in connection with an objection.

5.5 Source of data and mandatory nature

Data is collected directly from you, with the exception of browsing data generated automatically during your visit. Fields marked as mandatory in our forms are necessary to perform the requested service; without them, your order or request cannot be processed.

5.6 Recipients and processors

Data is processed by authorised ELEGELLI personnel and, where necessary, by service providers acting as processors within the meaning of Article 28 GDPR, in particular for Site hosting (Shopify), payment processing, logistics and delivery, email delivery and customer relations. These processors act on ELEGELLI's documented instructions and provide appropriate contractual safeguards. Data may also be disclosed to the competent administrative or judicial authorities where required by law.

5.7 Transfers outside the European Union

Certain processors may process data outside the European Economic Area. In that case, ELEGELLI ensures that the transfer rests on a lawful basis under Chapter V GDPR: an adequacy decision of the European Commission (in particular the EU-U.S. Data Privacy Framework for certified providers) or, failing that, Standard Contractual Clauses adopted by the European Commission, together with supplementary measures where appropriate. A copy of the safeguards implemented may be obtained on request at contact@elegelli.com.

5.8 Your rights

Subject to the conditions set out in the GDPR, you have the right of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20), objection to processing based on legitimate interest and, at any time and without giving reasons, to direct marketing (Art. 21), as well as the right to withdraw your consent at any time, without affecting the lawfulness of processing carried out before that withdrawal (Art. 7(3)).

You may also give directives concerning the fate of your data after your death, in accordance with Article 85 of French Law No. 78-17 of 6 January 1978, as amended.

ELEGELLI carries out no automated individual decision-making producing legal effects concerning you within the meaning of Article 22 GDPR.

These rights may be exercised at any time by writing to contact@elegelli.com or by post to the registered office. You will receive a response within one month of receipt of the request, extendable by two months where the request is complex. Proof of identity may be requested in the event of reasonable doubt as to the identity of the requester (Article 12(6) GDPR).

5.9 Complaint to the supervisory authority

You have the right to lodge a complaint with the French Data Protection Authority (CNIL), 3 place de Fontenoy — TSA 80715, 75334 Paris Cedex 07, www.cnil.fr, if you consider that the processing of your data breaches applicable regulations.

5.10 Security

ELEGELLI implements appropriate technical and organisational measures to ensure a level of security appropriate to the risk, in accordance with Article 32 GDPR, taking into account the state of the art, the costs of implementation and the nature, scope, context and purposes of processing. In the event of a data breach likely to result in a risk to your rights and freedoms, ELEGELLI will carry out the notifications provided for in Articles 33 and 34 GDPR.

6. Cookies and Other Trackers

The Site uses cookies and similar technologies, under the conditions set out in Article 82 of French Law No. 78-17 of 6 January 1978, as amended, and in the CNIL's guidelines and recommendation on cookies and other trackers.

  • Strictly necessary trackers (session management, shopping cart, authentication, security, load balancing, storing your consent choice): exempt from consent;
  • Audience measurement trackers: exempt from consent only where they meet the conditions set by the CNIL (strictly limited purpose, no cross-referencing of data, no tracking across sites or applications); otherwise subject to consent;
  • Personalisation, advertising and social media sharing trackers: placed only after your consent has been obtained.

Your consent is collected via the banner displayed on your first visit. Refusing is as easy as accepting. You may change or withdraw your choice at any time via the preference management interface accessible from the Site, or by configuring your browser. Your choice is stored for a maximum of six months, after which you will be asked again. The lifetime of the trackers placed does not exceed thirteen months, and the data collected is not retained beyond twenty-five months.

Refusing certain trackers may affect the availability of some features of the Site, but will never prevent access to the Site or the placing of an order.

7. Liability

ELEGELLI takes the greatest care to ensure that the information published on the Site is accurate and up to date. It does not, however, warrant its completeness, accuracy or timeliness, and reserves the right to modify the content at any time without prior notice. Product photographs and illustrations are not contractually binding.

Within the limits permitted by law, ELEGELLI shall not be liable for:

  • temporary unavailability or interruption of the Site, in particular for maintenance, updates, or reasons beyond its control;
  • direct or indirect damage resulting from use of the Site, from the inability to access it, or from the use made of the information appearing on it;
  • damage attributable to force majeure within the meaning of Article 1218 of the French Civil Code and French case law;
  • the presence of viruses or other harmful elements originating from third parties, users being responsible for protecting their own equipment.

Nothing in this notice is intended to, or has the effect of, excluding or limiting ELEGELLI's liability where the law does not permit it, in particular in cases of wilful misconduct, gross negligence or personal injury, nor of limiting the rights consumers derive from mandatory provisions of consumer law, in particular the legal guarantee of conformity (Articles L. 217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).

8. Hyperlinks

The Site may contain links to third-party websites. ELEGELLI exercises no control over those sites and disclaims all liability as to their availability, content, the products or services they offer, and the personal data processing carried out by their publishers. Activating such links is done at the user's sole responsibility.

Creating hyperlinks to the Site is permitted provided that they create no confusion as to the origin of the content, do not suggest a non-existent affiliation, partnership or endorsement, do not infringe ELEGELLI's rights, and comply with applicable law. Links to the Site using framing or inline linking techniques are prohibited. ELEGELLI reserves the right to request the removal of any link it considers contrary to its interests or to the law.

9. Consumer Relations and Dispute Resolution

9.1 Complaints and right of withdrawal

Any complaint should first be addressed to our customer service: contact@elegelli.com or ELEGELLI — Customer Service, 66 avenue des Champs-Élysées, 75008 Paris, France.

The terms of the fourteen-day right of withdrawal, the model withdrawal form and the online withdrawal function provided for in Article L. 221-21 of the French Consumer Code are set out in our Terms and Conditions of Sale, available on the Site.

9.2 Consumer mediation

In accordance with Articles L. 611-1 et seq. and R. 616-1 of the French Consumer Code, every consumer has the right to free recourse to a consumer mediator for the amicable resolution of a dispute with a trader, after first attempting to resolve the dispute through a written complaint addressed directly to ELEGELLI. The request must be submitted to the mediator within one year of that written complaint.

Note to the publisher — Article R. 616-1 requires the mediator's contact details and website address to be communicated visibly and legibly on the website, in the terms and conditions of sale, and on order forms. Membership of a mediation scheme is mandatory (Article L. 612-1): stating that the mediator will be "communicated on request" is not compliant. The official list of mediators approved by the CECMC is available at economie.gouv.fr/mediation-conso; schemes commonly used by e-commerce businesses include the FEVAD e-commerce mediator, CNPM — Médiation — Consommation, SAS Médiation Solution, MEDICYS, CM2C and the Association des Médiateurs Européens (AME).

9.3 European Online Dispute Resolution platform

The European Commission's Online Dispute Resolution (ODR) platform permanently ceased operations on 20 July 2025, following the repeal of Regulation (EU) No 524/2013 by Regulation (EU) 2024/3228 of 19 December 2024. A link to that platform is therefore no longer required or relevant. Recourse to national consumer mediation, as set out in 9.2, remains available.

10. Digital Accessibility

ELEGELLI endeavours to make the Site accessible to as many people as possible and to work towards the criteria of the French General Accessibility Improvement Framework (RGAA) and WCAG 2.1 level AA. ELEGELLI does not fall within the scope of the accessibility declaration obligation under Article 47 of French Law No. 2005-102 of 11 February 2005, which applies to private legal entities whose turnover generated in France exceeds €250 million, and benefits from the exemption for microenterprises providing services under Directive (EU) 2019/882 on accessibility requirements (the "European Accessibility Act"), transposed by Ordinance No. 2023-859 of 6 September 2023. Any difficulty in accessing the Site may be reported to contact@elegelli.com.

11. Governing Law and Jurisdiction

This legal notice is governed by French law. Failing an amicable settlement, any dispute relating to its interpretation or to the use of the Site shall be brought before the competent French courts in accordance with ordinary rules of jurisdiction.

Consumers retain the right to bring proceedings, at their choice, before any court having territorial jurisdiction under the French Code of Civil Procedure, or before the court of the place where they resided at the time the contract was concluded or the harmful event occurred (Article R. 631-3 of the French Consumer Code). The application of the mandatory protective provisions of the consumer's country of habitual residence is reserved, in accordance with Article 6 of Regulation (EC) No 593/2008 ("Rome I").

12. Language

This legal notice is drawn up in French, in accordance with French Law No. 94-665 of 4 August 1994 on the use of the French language. This English translation is provided for information purposes only; in the event of any discrepancy in interpretation between the two versions, the French version prevails.

13. Severability and Updates

If any provision of this legal notice is held to be void or unenforceable, the remaining provisions shall remain in full force and effect.

ELEGELLI reserves the right to amend this legal notice at any time to reflect changes in legislation, technology or its business. The applicable version is the one published on the Site at the time of consultation; users are invited to review it regularly.
